Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern your use of the Mashpad iOS application (the "App") and the website at https://mashpad.app (the "Site"), each provided by [LEGAL ENTITY NAME] ("Mashpad," "we," "us").

By installing, accessing, or using the App or the Site, you agree to these Terms. If you do not agree, do not install the App and do not use the Site.

If you obtain the App from Apple's App Store or TestFlight, your use is also subject to the Apple Media Services Terms and Conditions and any beta-testing terms presented to you. In the event of a conflict between Apple's terms and these Terms with respect to that distribution channel, Apple's terms control to the extent of the conflict.

2. Eligibility and intended audience

You must be at least 18 years of age — or the age of majority in your jurisdiction, whichever is higher — to use the App.

The App is intended for:

• Licensed craft distillers operating under a Distilled Spirits Plant permit or equivalent authorization;
• Hobbyist distillers in jurisdictions where home distillation is legal under the laws applicable to them;
• Educational, research, or historical interest in the subject of distillation.

The App is not a guide to producing distilled spirits and does not teach you how to distill. You are solely responsible for understanding and complying with all federal, state, provincial, and local laws and regulations that apply to your activities, including, in the United States, the Internal Revenue Code, regulations of the Alcohol and Tobacco Tax and Trade Bureau (TTB), and state alcohol-beverage laws. In the United States, distilling beverage alcohol without a federal permit is illegal regardless of state law. Whether your activity is lawful is a question for you and your counsel; we do not advise on it and do not represent that the App is appropriate for any particular use.

3. License grant

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple devices that you own or control, solely for your own personal or internal business use.

The App and the Site, including all content we provide, are licensed and not sold. We retain all right, title, and interest in and to the App, the Site, and all related intellectual property.

4. Restrictions

You will not, and will not permit others to:

• copy, modify, translate, or create derivative works of the App, except as expressly permitted by applicable law;
• reverse engineer, decompile, or disassemble the App, except to the extent applicable law expressly permits;
• rent, lease, sublicense, sell, or otherwise commercially redistribute the App;
• remove or obscure any proprietary notices in the App or the Site;
• use the App or the Site to violate any law or third-party right;
• use the App or the Site in a way that could damage, disable, or impair them or interfere with other users' use of them.

5. Your data and content

You retain all rights in the production data, recipes, photos, notes, and other content you create in the App ("Your Content"). Your Content remains on your device. We do not claim ownership of Your Content and do not access it.

You are responsible for Your Content and for backing it up. See our Privacy Policy for how we handle the limited information we do receive.

6. Calculations, estimates, and accuracy

The App provides calculators and estimators that apply standard distillation math, user-configurable defaults, and user-supplied inputs. These outputs — including yield estimates, cut-point predictions, dilution and proofing values, and inventory figures — are tools to support your own judgment. They are not guarantees, scientific measurements, or substitutes for the operator's responsibility to verify outcomes by direct observation. You make the final call.

The App's defaults — including wash profiles, still presets, and recipe templates — are starting points for your own tuning. We make no representation that any default value will match the behavior of your specific equipment or materials.

7. Beta software (TestFlight)

If you are using the App via Apple TestFlight, you understand that you are using pre-release software that may contain bugs, errors, incomplete features, or inaccuracies. We may modify, suspend, or discontinue the beta at any time without notice. Beta versions are provided "AS IS" with no warranty whatsoever.

We may receive anonymized crash and diagnostic information from beta builds in addition to general-release builds to fix bugs. Your use of the beta is governed by Apple's beta terms in addition to these Terms.

8. Updates

We may release updates to the App from time to time. Some updates may be required to continue using the App. Updates are delivered through the App Store or TestFlight and are subject to Apple's terms in addition to these Terms.

9. Pricing and purchases

As of the "Last updated" date above, Mashpad does not include in-app purchases or subscriptions. If we introduce paid features in the future, the pricing terms will be presented to you in the App or on the Site before you incur any charge, and any purchase will be processed by Apple under its own terms.

10. Termination

You may stop using the App at any time and uninstall it from your device. Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, limitations of liability, indemnification, and governing law — will survive.

We may terminate or suspend your license to use the App if you materially breach these Terms.

11. Disclaimer of warranties

The App and the Site are provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the App or the Site will be uninterrupted, error-free, secure, or that they will produce particular results.

Without limiting the above, we make no warranty as to the accuracy, completeness, or fitness for any purpose of any calculation, estimate, recommendation, or default value provided by the App. You are solely responsible for verifying outputs against your own observation, instruments, and experience.

12. Limitation of liability

To the maximum extent permitted by law, in no event will Mashpad, its developers, or its agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the App or the Site, even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to the App, the Site, or these Terms will not exceed the greater of (a) the total amount you have paid to us for the App in the twelve months preceding the claim, or (b) twenty United States dollars ($20.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent those provisions apply to you, the limitations above apply to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless Mashpad, its developers, and its agents from any claim, loss, liability, demand, damage, or expense (including reasonable attorneys' fees) arising out of or related to: (i) your use of the App or the Site; (ii) your violation of these Terms; (iii) your violation of any applicable law or third-party right; or (iv) any activity carried on by you in connection with distillation, including but not limited to any alleged unlicensed production of distilled spirits.

14. Governing law and disputes

These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in [COUNTY], [STATE] for any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will (a) advance the "Last updated" date above, (b) surface the updated Terms in the App on next launch, and (c) require re-acceptance when the App's on-device terms version number has been incremented. Continued use of the App after a material change constitutes acceptance of the updated Terms.

16. General

• Entire agreement. These Terms, together with our Privacy Policy and any in-app notices, constitute the entire agreement between you and Mashpad concerning the App and the Site.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
